Travel information can change without notice. Prices, opening hours, availability, routes, rules, permits, weather conditions, transportation schedules and other details may become outdated after publication.

We make reasonable efforts to keep our information accurate, but we do not guarantee that all information published on the website will always be complete, accurate, current or error-free.

You should independently verify important information with the relevant operator, authority, accommodation provider, transport provider or other applicable source before making decisions or travelling.

Our travel content is provided for general informational purposes and should not be treated as a guarantee of any particular travel experience, outcome, price, availability, safety level or service quality.

4. PERSONAL EXPERIENCES & RECOMMENDATIONS

Some content published by Xplore The Earth represents our personal experiences, opinions, observations and recommendations.

Unless expressly stated otherwise, recommendations do not constitute official endorsements, guarantees or representations on behalf of the businesses, destinations, authorities, hotels, restaurants, tour operators, transport providers or other entities mentioned.

6. DIGITAL TRAVEL GUIDEBOOKS

Certain travel guidebooks sold through this website are provided in digital PDF format.

Purchase of a digital guidebook grants the purchaser a limited, non-exclusive, non-transferable licence to access and use the guidebook for personal, non-commercial purposes. It does not transfer ownership or copyright in the guidebook to the purchaser.

Unless permitted by applicable law or expressly authorised by XTE Travel LLP in writing, purchasers may not:

  • forward or share the PDF with other persons;
  • upload it to websites, social-media platforms, messaging groups, forums, cloud-storage services or file-sharing platforms for third-party access;
  • resell, redistribute, sublicense or commercially exploit the guidebook;
  • reproduce, republish or distribute substantial portions of the guidebook;
  • copy its original written content, maps, graphics, photographs, itineraries or other protected elements for another publication or commercial product;
  • remove watermarks, copyright notices or other rights-management information;
  • claim authorship or ownership of the guidebook or its original content; or
  • use the guidebook or substantial portions of its content to create a competing travel product or commercial service.

Unauthorised distribution, reproduction or commercial exploitation may constitute copyright infringement and/or breach of the licence granted through purchase.

We may use reasonable technical or administrative measures, including purchaser-specific watermarks or identifying information, to protect digital products against unauthorised distribution.

7. PHYSICAL GUIDEBOOKS & MERCHANDISE

We may offer physical products including printed travel guidebooks, T-shirts and other merchandise.

Product images shown on the website are intended to provide a reasonable representation of the products. Actual colours, finishes, dimensions or appearance may vary slightly depending on manufacturing, photography and display settings.

Product availability, specifications and prices may change without prior notice.

We reserve the right to limit quantities, discontinue products or refuse an order where reasonably necessary, including in cases of pricing errors, inventory issues, suspected fraud or other operational circumstances.

Where an order has been successfully accepted and paid for, any cancellation, return, replacement or refund will be handled in accordance with the applicable product-specific policy and applicable consumer law.

8. ORDERS & PAYMENTS

When you place an order through our website, you are making a request to purchase the selected product or service.

An order may be subject to availability, payment verification and other reasonable checks.

We reserve the right to cancel or decline an order where there is a genuine operational, technical, payment, inventory or fraud-related reason.

If an order is cancelled by us after payment has been successfully received, the applicable amount paid will be refunded in accordance with the applicable refund policy.

Prices displayed on the website are subject to change. Where applicable, taxes, shipping charges, delivery charges or other fees will be displayed during the purchase process.

You are responsible for providing accurate billing, shipping, contact and other information necessary to fulfil your order.

9. SHIPPING & DELIVERY

For physical products, delivery timelines displayed on the website are estimates unless expressly stated otherwise.

Delivery may be affected by courier delays, weather, public holidays, strikes, natural events, incorrect addresses, failed delivery attempts, restrictions imposed by authorities or other circumstances beyond our reasonable control.

You are responsible for providing a complete and accurate delivery address and contact information.

Where a shipment cannot be delivered because of an incorrect address, refusal to accept delivery, repeated failed delivery attempts or circumstances attributable to the purchaser, additional shipping or re-delivery charges may apply where reasonably incurred.

Specific products may have additional delivery terms, which will be communicated at the time of purchase.

10. RETURNS, REFUNDS & CANCELLATIONS

Refunds, cancellations, returns and replacements are subject to the applicable product or service policy displayed on the website and applicable law.

Digital products

Because digital guidebooks are electronically delivered products, orders may generally not be cancellable or refundable once the digital product has been delivered or access has been provided, except where required by applicable law or where the product is defective, inaccessible or materially different from what was offered.

Physical products

Returns, replacements or refunds for physical products will be handled according to the applicable product-specific return/refund policy, including any conditions relating to damaged, defective, incorrect or materially misdescribed products.

Consultation services

Cancellation or rescheduling of consultation calls will be governed by the booking and cancellation terms displayed at the time of booking.

Nothing in these Terms is intended to exclude or restrict any consumer right or remedy that cannot lawfully be excluded or restricted.

11. TRAVEL CONSULTATION SERVICES

Xplore The Earth may offer paid one-on-one travel consultation calls to assist customers with itinerary planning and travel-related questions.

The consultation service may include, depending on the package purchased:

  • discussion of the customer’s proposed trip;
  • itinerary planning;
  • destination recommendations;
  • route planning;
  • practical travel suggestions;
  • budgeting guidance;
  • activity or accommodation suggestions; and
  • other travel-planning assistance described on the relevant booking page.

Important limitations

Our consultation service provides travel-planning assistance and recommendations, not professional, legal, medical, financial, insurance, immigration or safety advice.

We do not guarantee that a particular itinerary, recommendation, accommodation, transportation option, activity or travel plan will be suitable for every traveller.

Travel conditions can change after a consultation. Customers remain responsible for independently verifying current prices, availability, permits, visa requirements, entry requirements, health requirements, local regulations, weather conditions, transportation schedules and other important information before travelling.

A consultation does not create an agency, partnership, employment, fiduciary or other similar relationship between the customer and XTE Travel LLP.

12. CONSULTATION BOOKINGS

Customers booking a consultation are responsible for providing accurate information about their trip, including dates, destinations, group size, preferences, constraints and other information relevant to the consultation.

We may rely on the information provided by the customer when preparing recommendations.

If a customer provides incomplete or inaccurate information, the resulting recommendations may not be suitable for the actual trip.

If a consultation is cancelled or rescheduled, the applicable cancellation and rescheduling terms displayed at the time of booking will apply.

We reserve the right to reschedule a consultation where reasonably necessary due to illness, technical issues, emergencies or other circumstances beyond our reasonable control.

13. THIRD-PARTY BUSINESSES & LINKS

Our website may contain links, references, affiliate links or recommendations relating to third-party websites, hotels, restaurants, transport providers, tour operators, booking platforms, products or services.

These third parties operate independently of XTE Travel LLP.

We do not control their websites, policies, availability, pricing, services, security or business practices and are not responsible for their content, actions, failures or changes.

If you purchase a third-party product or service through an external platform, your transaction may be governed by that third party’s terms and conditions and policies.

Where we receive an affiliate commission or other commercial benefit from a qualifying transaction, this does not by itself guarantee that the third-party service will be suitable for your particular requirements.

14. USER-SUBMITTED CONTENT

If you submit comments, reviews, photographs, videos, messages, testimonials or other material to Xplore The Earth through the website, social media, email, forms or other channels, you remain responsible for ensuring that you have the necessary rights to provide that material.

You must not submit material that:

  • infringes another person’s copyright, trademark, privacy or other rights;
  • is unlawful, fraudulent or misleading;
  • contains malicious code;
  • contains confidential or sensitive information belonging to another person without authorisation; or
  • violates applicable law.

Where you voluntarily submit content for publication, you grant XTE Travel LLP a non-exclusive, royalty-free licence to use, reproduce, display, adapt and publish that content for operating, promoting and communicating about Xplore The Earth, subject to applicable law and any specific terms communicated at the time of submission.

We may remove or decline to publish submitted content at our discretion.

15. PHOTOGRAPHS, PEOPLE & THIRD-PARTY RIGHTS

Our content may include photographs or videos featuring locations, events, businesses or individuals.

We make reasonable efforts to respect applicable rights and permissions. If you believe that content published by us infringes your copyright, privacy or other legal rights, please contact us with sufficient information to identify the material and the basis of your concern.

We may investigate and, where appropriate, remove, modify or otherwise address the relevant content.

16. ACCURACY, AVAILABILITY & WEBSITE INTERRUPTIONS

We endeavour to keep the website operational and its content reasonably accurate and current.

However, we do not guarantee that:

  • the website will always be available or uninterrupted;
  • the website will be free from technical errors;
  • all content will always be current;
  • all products will always be available;
  • all website functions will operate without interruption; or
  • the website will be free from viruses or other harmful components.

We may update, modify, suspend or discontinue any portion of the website, content, products or services from time to time.

17. LIMITATION OF LIABILITY

To the extent permitted by applicable law, XTE Travel LLP shall not be responsible for losses arising solely from a user’s reliance on general travel information published on the website where such information has subsequently changed or become outdated.

We are not responsible for circumstances outside our reasonable control, including changes to government regulations, visa requirements, weather, natural disasters, transportation schedules, strikes, closures, cancellations, third-party service failures or other unforeseen travel circumstances.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Nothing in these Terms is intended to exclude or restrict statutory consumer rights or remedies that cannot legally be excluded or restricted.

18. INDEMNITY

To the extent permitted by applicable law, you agree to indemnify and hold harmless XTE Travel LLP, Xplore The Earth and their respective owners, employees, representatives and contractors from claims, losses, liabilities, damages, costs or expenses arising from:

  • your unlawful or unauthorised use of the website;
  • your violation of these Terms;
  • your infringement of another person’s intellectual-property or other legal rights; or
  • your misuse of products, services or content provided by Xplore The Earth.

This clause does not apply to the extent that the relevant claim arises from our own unlawful conduct or liability that cannot legally be transferred to you.

19. COPYRIGHT & CONTENT INFRINGEMENT

If you believe that any content on our website infringes your copyright or other intellectual-property rights, please contact us with:

  • identification of the work or material concerned;
  • identification and location of the allegedly infringing content;
  • information establishing your ownership or authority to act;
  • your contact details; and
  • any other information reasonably necessary for us to assess the claim.

We reserve the right to take appropriate action where infringement is established or reasonably demonstrated.

20. PRIVACY

Your use of this website may involve the collection and processing of personal information.

Our handling of personal information is governed by our Privacy Policy, which forms part of these Terms by reference.

Please review our Privacy Policy before using the website or submitting personal information.

21. CHANGES TO THESE TERMS

We may update or modify these Terms from time to time to reflect changes to our website, products, services, business practices or applicable law.

The updated version will be published on this page with the revised “Last Updated” date.

Your continued use of the website after updated Terms are published constitutes acceptance of the updated Terms to the extent permitted by applicable law.

22. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable consumer-protection laws and the jurisdiction granted to competent statutory authorities and consumer commissions, disputes arising in connection with these Terms or your use of the website shall be subject to the jurisdiction of the courts having competent jurisdiction over Noida, Uttar Pradesh, India.

Nothing in this clause is intended to prevent a consumer from exercising any statutory right to approach a competent consumer commission or other authority where such right is available under applicable law.

23. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it enforceable, where legally permissible.

The remaining provisions shall continue in full force and effect.

24. ENTIRE AGREEMENT

These Terms, together with the applicable Privacy Policy, Refund/Cancellation Policy, Shipping Policy and any product- or service-specific terms displayed at the time of purchase, constitute the terms governing your use of the website and purchase of our products and services, except where a separate written agreement expressly applies.
